Workers' Compensation Insurance: Protecting Your Team and Your Business

Your employees are your most valuable asset — and your greatest liability if you don’t have the right coverage in place. Workers’ compensation insurance is required by law in most states, but beyond compliance, it’s a critical tool for protecting your workforce and your bottom line.

How Workers’ Comp Works

Workers’ compensation provides medical benefits and wage replacement to employees who are injured or become ill as a direct result of their job. In exchange, the injured employee generally cannot sue the employer for negligence. This no-fault system benefits both parties: employees get guaranteed support, and employers get protection from potentially catastrophic personal injury lawsuits.

What It Covers

Workers’ comp covers medical treatment costs for work-related injuries and illnesses, temporary and permanent disability benefits, rehabilitation and retraining costs, and death benefits for families of workers killed on the job. It does not cover injuries that occur outside the scope of employment, intentional self-harm, or injuries sustained while intoxicated.

Industry-Specific Considerations

The premium you pay for workers’ comp is driven largely by your industry’s class code and your claims history. Construction companies, manufacturers, warehouse operators, and cannabis cultivators typically pay higher rates due to elevated injury risk. Remote and clerical workers, by contrast, qualify for lower rates. Properly classifying your employees — and fighting misclassifications — can save your business thousands of dollars annually.

Experience Modification Rate (EMR)

Your experience modification rate (EMR) compares your claims history to other businesses in your industry. An EMR below 1.0 means you have fewer claims than average — and you’ll pay lower premiums. An EMR above 1.0 means the opposite. Implementing a robust safety program, investigating every claim, and returning injured employees to light-duty work quickly are all strategies for keeping your EMR low.
